TERMS AND CONDITIONS

These Terms and Conditions ("T&Cs") constitute a legally binding agreement between you and BC Malaysia Sdn. Bhd. (Company No. 201001023376). By accessing or using this website (http://www.bonchon.com.my), you agree to be bound by these terms.

1. Eligibility & Account Security

  • Age Requirement: You must be 18 years of age or older to create an account. Minors under the age of 18 may only use this website and participate in programs with the express consent and supervision of a parent or legal guardian.
  • Account Responsibility: You are responsible for all activity under your account. Keep your credentials secure.

2. Intellectual Property

  • All content (logos, branding, text, graphics) is the exclusive property of BC Malaysia Sdn. Bhd. or its licensors.
  • You are granted a limited license for personal, non-commercial use only.

3. Online Ordering, Payments & Refunds

  • Order Acceptance: We reserve the right to refuse orders due to pricing errors, stock shortages, or suspected fraud.
  • Perishable Goods & Failure to Collect: Due to the perishable nature of our food products, orders placed for in-store pickup or table fulfillment must be collected at the designated time. BC Malaysia Sdn. Bhd. shall not be liable, and no refunds or replacements will be issued, for items not collected by the customer on the specified order date.
  • Refund Policy: In the event of an order cancellation initiated by us, a full refund will be processed to your original payment method within fourteen (14) working days.
  • Pricing & Taxes: Prices are in MYR and inclusive of applicable government taxes (e.g., SST).

4. Food Safety & Liability

  • Disclaimer: While we strive for accuracy, the website is provided "as is."
  • Dietary & Ingredient Information: We strive to provide accurate ingredient and allergen information on our menu. Customers with severe food allergies or specific dietary requirements are advised to consult our staff before placing an order.
  • Regulatory Compliance: Nothing in these terms excludes our liability for obligations imposed by the Food Act 1983 or other mandatory Malaysian consumer safety regulations regarding product quality and safety.

5. Loyalty Program

  • Participation is governed by the Bonchon Loyalty Program Terms of Service, which are incorporated into these T&Cs by reference.
  • Points, rewards, and redemption thresholds are subject to change, but we will provide reasonable notice for material changes.

6. Limitation of Liability

  • Except as required by law, our total liability for any claim arising from a transaction shall not exceed the total amount paid by you for that specific order.
  • We are not liable for any indirect or consequential damages.

7. Force Majeure

  • We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, war, pandemic, government-mandated lockdowns, or major telecommunication infrastructure failures.

8. Changes to Terms & Notice

  • We reserve the right to update these T&Cs. For significant changes, we will provide reasonable notice via a website banner or email to registered users.
  • Continued use after such notice constitutes your acceptance of the updated terms.

9. Governing Law & Dispute Resolution

  • Governing Law: These terms are governed by the laws of Malaysia.
  • Dispute Resolution: We encourage resolution through our customer support channels. Unresolved consumer disputes may be referred to the Consumer Claims Tribunal of Malaysia (TTPM).
  • Jurisdiction: All other legal matters are subject to the exclusive jurisdiction of the courts of Malaysia.
